This Policy is intended to inform you of your rights under the General Data Protection Regulation (GDPR) and other applicable data protection laws.

1. Data Controller and Data Processor Roles

Depending on how the Software is used, Galvani Power SRL may act either as (i) an independent data controller for personal data related to account creation, billing, security, and service management; and/or (ii) a data processor on behalf of the customer (the “Customer”), where the Customer uploads or otherwise processes personal data through the Software for its own purposes. In such cases, the Customer is the data controller for such customer-provided personal data.

2. What's the point of this policy?

2.1 This policy tells you what to expect when we collect your personal information. Please only use our service if you are completely happy with this policy.

2.2 This Policy generally covers personal data that we process as a data controller (e.g., account, billing, security, website analytics). Where the Customer uses the Software to process personal data about its own users, employees, or third parties, the Customer acts as data controller and we act as data processor. If this applies, please contact the relevant Customer to exercise your rights.

3. Personal Data We Collect

  • Identifying Information: Name, surname, age, company name, company information, email address, phone number.
  • Account Information: Account credentials, subscription details, billing information.
  • Usage Data: Information about how you interact with the Software, such as IP address, browser type, access times, and pages viewed.
  • Device Information: Device type, operating system, and version.
  • Billing Information: Billing address, last four digits and expiry date of credit card from our payment providers.
  • Automated Information: Login details, referral site, search queries, and transactional data.

4. Legal Basis for Collection

We collect your data to provide services under contract. Additional uses (like marketing) are subject to your consent. We process browsing and technical data based on legitimate interest to improve our service.

5. How We Use Your Data

  • Operate and maintain the Software.
  • Process transactions and support.
  • Communicate updates and changes.
  • Send service-related communications (such as security notices, account notices, and changes to the Services). These are not marketing messages.
  • Analyze and improve performance.
  • Comply with laws and resolve disputes.

6. What About Cookies?

We and/or third parties use cookies to enhance functionality and track usage. Rejecting cookies may limit functionality.

  • Session cookies: Temporary and deleted on close.
  • Operational cookies: Persistent for sessions and affiliate tracking.
  • Google cookies: Analytics and metrics.
  • Social media cookies: Facebook, etc.
  • Payment cookies: Stripe, PayPal, etc.
  • Cookie-warning cookie: Saves your preferences for 1 year.

8. How Long Do We Keep It?

Data is deleted upon account closure unless needed for tax/legal reasons, in which case it's retained for up to five years. Marketing data is retained until opt-out or deletion. Account downgrade to a free plan is not the same as account closure; data retention during a free plan remains subject to the User’s continued use of the Software and our operational requirements.

9. Who Do We Share Your Data With?

  • Service providers (hosting, analytics, communication).
  • The public (if you post on public forums).
  • Authorities (if legally required or to enforce our rights).
  • Buyers/investors (if ownership changes).

10. Payment Details

Payments are processed externally (e.g., Stripe/PayPal). We do not store full credit card information.

  • Restrict processing in some situations.

14. Changes to This Policy

We may update this Policy from time to time. Where required, we will provide advance notice (for example by posting a notice on our website, within the Software, or by email). Unless otherwise required by applicable law, your continued use of the Software after the effective date of an updated Policy means you accept the updated Policy.

Where the User has entered into a separate written agreement governing a specific trial or project, the version of this Policy in force at the date of signature of such agreement shall apply for the duration of that agreement. Upon its expiration, the then-current version of this Policy shall apply to any continued use of the Software.
